QuantWise Draw Disclaimer
- The Draw hereby offered by Quantwise Labs LTD (the “Draw”), a company incorporated under the laws of the British Virgin Islands, holding the incorporation number 2126403, is open to residents of their respective countries where it is not prohibited by law, provided they are 18 (eighteen) years of age or older at the time of entry. Quantwise reserves the absolute right to verify the eligibility of each entrant at its sole discretion.
- The participant of the Draw must ensure that their participation complies with the laws and regulations of their country of residence at the time of the Draw. QuantWise does not guarantee that participation in the Draw conforms to local laws and regulations, and it explicitly disclaims any responsibility if participants violate local laws relevant to their circumstances by taking part in this Draw.
- By entering, the participant agrees to abide by these terms and acknowledges that QuantWise’s decisions are final and binding in all matters related to the Draw.
- Applications will begin on March 31, 2024, and end on June 30, 2024 (“Submission Period”).
- Participants are eligible to enter the Draw by complying with each of the following criteria during the Submission Period and before the Draw takes place. The Draw is only available to new users who do not already have a QuantWise account, and have not yet made their first deposit with QuantWise:
- Sign up and register for a QuantWise account.
- Complete KYC verification to confirm your eligibility
- Deposit the minimum amount of 500 USDT (Five Hundred United States Dollars Tether) into your Quantwise account.
- Post on your Instagram profile using the hashtag #BeWiseJoinQuantWise.
- During the Submission Period, each eligible person is limited to 1 (one) entry, regardless of the number of email addresses or accounts they possess. Any attempts at multiple entries beyond this limit or mass entry endeavors will lead to disqualification of all entries by the individual concerned. QuantWise reserves the right to disqualify incomplete entries at its sole discretion. Personal information collected in relation to this Draw may be utilized in accordance with QuantWise’s Privacy Policy, accessible at https://docs.quantwise.ai/terms/privacy-and-cookies.
- At the conclusion of the Submission Period, all eligible entries will be compiled into a database. QuantWise will randomly select one winner using a random picker tool and will notify the winner directly using the contact details provided during account registration.
- The Prize is equivalent to a TESLA Model Y valued at approximately USD 50,000 (Fifty Thousand United States Dollars) (the “Prize”). The Prize will be available in the United Arab Emirates. The winner is responsible for any and all local, county, state, and federal requirements in relation to the Prize and its registration and any taxes applicable to the Prize (including any logistical or transport costs for collecting the Prize and delivering it to your destination of choice). Additionally, the winner is responsible for all costs associated with registration, Tesla membership, dealer preparation, and maintaining insurance as required.
- The Drawing Event is scheduled for July 2024 (“Drawing Event”) and will be conducted through a random drawing using a random draft through the internal QuantWise database of users who meet all the requirements. Please note that the Drawing Event is subject to change at QuantWise’s sole discretion. If the initial winner is disqualified or deemed ineligible for any reason whatsoever, QuantWise reserves the right to select an alternate winner by conducting an additional random drawing from the remaining valid entries.
- The winner will be publicly announced within 30 days after the Drawing Event. Notification and instructions regarding the Prize will be sent to the winner via email. It is the responsibility of each participant to regularly check their email used for the QuantWise registration account for Prize notifications, receipts, or any other communications related to this Draw. If a potential winner cannot be contacted within 15 days using the contact information provided at the time of entry, that potential winner will forfeit the Prize.
- The Prize is not transferable, non-negotiable, or exchangeable by the winner to any other entrant.
- Equivalent cash alternatives may be available for participants located outside the United Arab Emirates who are unable to accept the Prize.
- The Prize must be claimed within 15 days of the Prize notification. If, for any reason, the Prize cannot be awarded, QuantWise reserves the right to substitute it with another prize of equal or greater value, as determined by QuantWise in its sole discretion.
- The winner will be required to sign an affidavit of eligibility/publicity and liability release and return it properly executed within 5 days of the notification. Failure to return the documents as specified will result in the entry being disqualified and an alternative winner selected.
- The winner will be requested to be in Dubai, United Arab Emirates for a promotional shoot (photo and video) for the public disclosure of the winning. If the winner is located outside Dubai, United Arab Emirates, QuantWise will provide tickets for a roundtrip to reach the shoot.
- By accepting the Prize, the winner agrees to the following conditions: (i) all decisions made by QuantWise regarding the Draw are final and binding; (ii) releasing QuantWise and its affiliates, officers, directors, employees, agents, third-party partners, and licensees from any claims related to the Draw and the Prize; (iii) allowing QuantWise to use their personal information for advertising purposes without additional compensation; and (iv) signing a publicity release where permitted by law, including full and unfettered use of any promotional shoot material. QuantWise is not liable for failure to supply the Prize due to circumstances beyond QuantWise’s control, and all costs beyond those specified are the winner’s responsibility. QuantWise disclaims any warranties or guarantees regarding the Prize. Taxes and additional expenses not specified are the responsibility of the winner.
- QuantWise, at its sole discretion, reserves the right to disqualify and prohibit from participating any individual who QuantWise determines is or is attempting to: (i) tamper with any aspect of the Draw; (ii) undermine the legitimate operation of the Draw through cheating, deception, or other unfair practices; (iii) engage in behavior intended to annoy, abuse, threaten, or harass other participants, agents, or representatives of QuantWise; (iv) engage in or make any defamatory, abusive, or disparaging comments regarding QuantWise, its agents, affiliates, or representatives, or about any other participants; and/or (v) violate the terms of participation.
- The Draw is subject to the laws of the British Virgin Islands. By participating, participants agree that any disputes or causes of action arising out of or connected with the Draw shall be resolved individually, without resorting to any form of class action, exclusively before the competent local court. Participants also waive rights to claim punitive, incidental, or consequential damages, including reasonable attorney’s fees, and agree to waive rights to have damages multiplied or increased, except for actual out-of-pocket expenses associated with entering the Draw. QuantWise’s aggregate liability is limited to $50,000.
- Participants release and hold harmless QuantWise, its subsidiaries, affiliates, third-party partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, including (but not limited to): (i) participation in the Draw and/or acceptance, possession, use, or misuse of the Prize; (ii) technical failures, including but not limited to malfunctioning of any computer, cable, network, hardware, or software; (iii) unavailability or inaccessibility of transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Entry; and (v) electronic or human error in the administration of the Entry or processing of entries.
